ALL graves, lots and plots in FAIRVIEW CEMETERY OF STATEN ISLAND, INC. are sold in accordance with the provisions of the laws of the State of New York and shall not be used for any purpose other than as a burial place for deceased human beings.
NO interment shall be allowed without permission from the Cemetery. At the time of applying for interment, the following information must be furnished:
1. Name and age of decedent
2. Date and place of birth, if known
3. Date and place of death
4. If decedent is a minor, the names of parents or
legal guardians must be supplied
5. Date and time of interment
6. Burial permit from the Department of Health of the
county or city wherein death occurred.
SALES of graves shall be limited to native-born Staten Islanders or Staten Island residents at time of death. No purchase of graves for future use will be permitted.
LOT OWNERS are prohibited from allowing interments, including cremains, to be made in their graves without knowledge of the Cemetery.
INTERMENTS in a lot or plot are restricted to those entitled to burial therein according to the terms of Section #1512 of the Not-For-Profit Corporation Law. Written permission for burial of those not entitled to interment under said Section must be filed with the Cemetery by the lot or plot owners.
EXCEPT as provided for in Section #1513 of the Not-For-Profit Corporation Law, no lot or plot owner may transfer his or her lot or plot, or any portion thereof.
NO “FOR SALE” sign indicating that a grave or plot is for sale will be permitted on the Cemetery grounds.
THE full purchase price must be paid before title will be issued or interment permitted in any grave, lot or plot.
FUNERALS must be at the Cemetery by 1:00 P.M. in order that workmen will have sufficient time to properly close the grave and remove equipment before 4:00 P.M. No
burials permitted on holidays, Sundays, or after NOON on Saturdays.
CASKETS shall require a concrete outer container in graves purchased after Jan. 1, 1985.
ALL foundations, footings and foundation repairs shall be made by the Cemetery.
ONLY one monument or marker shall be permitted on a single grave and shall be set in accordance with the general plan of the Cemetery. ALL monuments must be constructed of granite or bronze.
NO footstones, foot markers, corner stones, corner markers or posts shall be permitted.
THE cemetery will not be responsible for any permanent or temporary monuments, markers, flowers, bushes, vases, containers or any ornaments placed on the graves.
THE bases of monuments or markers shall be finished true and level so as to fit on foundations. No monument or marker may be delivered to the Cemetery until the foundation has been installed and ready to receive the monument or marker. No foundations will be installed until at least six months after date of burial, depending upon weather conditions. Please call Cemetery for details regarding monuments for Section T.
After due notice to lot owners, the Cemetery reserves the right to remove any effigies or inscriptions which, in the opinion of the Board of Trustees, are unsightly or dangerous.
FURTHER, the Cemetery must approve any proposed monument, marker or inscription.
The only enclosures permitted must be brick or stone as they do not interfere with grass cuttings. Absolutely no plastic or vinyl fences allowed. Glass containers, vases and candles are also prohibited.
NO trees, bushes or plants of any kind such as azaleas, cedars or yews may be planted. Low-growing flowers such as tulips, impatiens, etc. may be planted within twelve inches from the headstone, but not on either side of markers or monuments. Those plants interfering with grass cutting, burials and general maintenance will be removed by the Cemetery.
ALL work done in the Cemetery shall be by Cemetery employees or under control of the Board of Trustees.
HEAVY trucks or other such vehicular traffic shall be refused entrance to Cemetery when, in the opinion of the Board, injury to roads, driveways or lawns may result.
THE Cemetery shall in no way be liable for any delay in the interment of a body where a protest to such interment has been made or where these Rules and Regulations have not been complied with. Any protests of interments must be in writing.
DISINTERMENTS will be permitted according to provisions of Section #1510(e-f) of the Not-For-Profit Corporation Law.
LOT owners must notify the Cemetery of any change of address. All correspondence sent by the Cemetery to the last recorded address shall be deemed adequate.
